    It is unsurprising that no case law supports the
    dissent. Under its view, Congress’s power to investigate, when
    it comes to the President and all other impeachable officials,
    would no longer be “co-extensive with [its] power to legislate.”
    Quinn, 349 U.S. at 160. The dissent would reorder the very
    structure of the Constitution. Throughout history, the
    Constitution has left to Congress the judgment whether to
    commence the impeachment process. But the dissent’s
    approach would not even allow Congress to make the
    quintessentially legislative judgment that some concerns about
    potential misconduct or illegality are better addressed through
    oversight and legislation than impeachment. Worse still, the
    dissent’s novel approach would now impose upon the courts
    the job of ordering the cessation of the legislative function and
    putting Congress to the Hobson’s Choice of impeachment or
    nothing.
    I'm surprised none of our strict constructionists are screaming about legislating from the bench here.

              Escalating the time table for impeachment helps Trump and Pelosi knows this. Every day, more and more Americans support his impeachment. And quixotically, Trump & Co. keep giving them further reasons to do so. Any normal President would just shut the fuck up and lay low. With Trump, we get the opposite. It’s not his style. I realize that, for most Senate Republicans, there is no bridge too far in terms of their loyalty to Trump. They’ve made their political beds and now, at least publicly, lie on them. If the Senate were to decide to vote privately? Yeah. You might have 30-35 Republicans vote to convict. Whether McConnell would do that is the real question. If they were to do that, however, I predict Trump would be gone.

                Fortunately for Trump, Democrats won't be content to take their case to the electorate. They will insist on taking actions which will probably be detrimental to their own party come next November.

                  It’s possible. But, that was also said when Nixon was being impeached. What’s playing out with Senate Republicans is fairly straight forward. They’re worried about retaliation by Trump’s base with regards to their own re-elections... and with good reason. It will take years to clean our government of Trump’s stench.

                    Give me a break. Trump hasn't done anything that won't be undone in the first 100 days of the next administration. It isn't like he pushed through permanent new entitlements like his predecessor. Republicans don't like Trump and will jump to the next clown as soon as they have a chance. A bunch of them have decided to retire rather than run for re-election.

                            Yeah but that's the nature of the position. We had to deal with the effects of Obama's foreign policy like allying us with the Kurds in Northern Syria while pissing off our NATO ally in Turkey. Then he just left it like that.
